Mediation techniques are the methods a mediator uses to move parties from fixed positions to a workable agreement. In the Netherlands mediation is voluntary and nothing the mediator says is binding; what binds the parties is the settlement agreement (vaststellingsovereenkomst) they sign at the end, under Article 7:900 of the Dutch Civil Code (BW).

The five techniques below are the ones most used in Dutch practice, and experienced mediators switch between them within one case.

How is mediation regulated in the Netherlands?

There is no general Dutch statute that licenses mediators or prescribes a procedure; the profession is organised privately. The register of the Mediators Federation Netherlands (Mediatorsfederatie Nederland, MfN) sets training requirements, a code of conduct and a complaints and disciplinary procedure.

A judge can suggest mediation at any stage of proceedings and refer the parties to the court’s mediation desk, but cannot force them to take part or to settle. For cross-border disputes within the EU, Article 3 of the Dutch act implementing the European Mediation Directive (Directive 2008/52/EC) confirms that the court may propose mediation at any stage.

A position is what a party says it wants; an interest is why it wants it. Interests are compatible far more often than positions, so the mediator’s first move is to get behind the demands with questions such as “what does this payment need to achieve for you?”

An example to illustrate: in a ជម្លោះកិច្ចសន្យា one party demands immediate payment in full, the other a long deferral. Behind this can be a supplier with a cash-flow problem and a buyer who objects only to the timing of one instalment, leading to a payment schedule neither would have proposed. If a party has no interest beyond being proved right, the case may not suit mediation, and that is best established in the first session.

Technique two: facilitative mediation

In facilitative mediation the mediator runs the process but gives no opinion on the merits and proposes no solution. It is the dominant model in the Netherlands and the one the court mediation desks work with.

The craft lies in sequencing: discussing the conflict, then interests, then options, and only then negotiating. Separate sessions with each party (caucus) are used to test a bottom line without conceding it at the table. What is said in caucus stays there unless the party agrees otherwise, which must be laid down in the mediation agreement because general law does not provide it.

Technique three: transformative mediation

Transformative mediation aims first at empowerment, each party regaining the ability to decide, and recognition, each party acknowledging the other’s perspective without conceding the merits. Settlement follows from that.

It is useful where parties must keep dealing with each other: business partners, a family business, co-parents, neighbours, or a works council and a board. It fits poorly where the relationship is over and speed matters.

In evaluative mediation the mediator, usually a lawyer, gives a reasoned view of how a court would probably assess the dispute and what litigation would cost in money and time. It is used when talks stall on the legal position, typical in commercial, insurance and construction disputes.

It carries the greatest risk to neutrality. Three safeguards apply: obtain and record the parties’ express consent before giving any view, assess both sides including the weaknesses of the party who seems favoured, and state that this is a range of likely outcomes, not a prediction.

Each party arrives with a consistent story that is incompatible with the other’s. The mediator draws out both versions, then asks questions that allow a third account in which the problem, not the other party, is the opponent.

Useful questions are: when did the relationship work and what was different then, and what would a neutral outsider say? Restating a hostile remark as the need behind it also helps. The technique is effective in international files, where the same conduct carries different meanings in different cultures.

How confidential is mediation?

Confidentiality rests mainly on the mediation agreement, not on statute. In a purely domestic case there is no general statutory privilege for mediators in Dutch civil proceedings comparable to that of lawyers, notaries and doctors.

The parties and mediator therefore agree in writing not to disclose what is said, not to call the mediator as a witness and not to use mediation documents in later proceedings; a penalty clause makes this enforceable. A document that exists independently does not become privileged by being shown in mediation. In cross-border EU disputes, Article 5 of the implementing act lets the mediator and those involved refuse to testify if confidentiality was expressly agreed.

How do you make the outcome enforceable?

A successful mediation ends in a settlement agreement under Article 7:900 BW, which binds the parties even where it departs from what the law would have given them. Define what is settled, deal with final discharge, and state what happens if an instalment is missed. Our guide to the settlement agreement and what to watch for covers the standard clauses.

A signed settlement is not itself an enforceable title. For direct enforcement you need a notarial deed, which is an enforceable title under Article 430 of the Dutch Code of Civil Procedure (Rv), or, in pending proceedings, a settlement recorded by the court in an official report (proces-verbaal) in enforceable form.

In a domestic case starting mediation does not interrupt a limitation period. If a claim is close to becoming time-barred, interrupt it first by written notice under Article 3:317 BW; for a damages claim that notice must be followed within six months by a further step, such as a writ or an acknowledgement. In a cross-border EU dispute, Article 6 of the implementing act provides that the start of mediation interrupts the limitation period.

When is mediation the wrong route?

Mediation works badly where there is a serious imbalance of power or information, where a party needs a binding ruling on a point of principle, or where urgent relief is needed in summary proceedings (kort geding). It also fits poorly when a party cannot settle on its own, for example because an insurer or supervisory board decides.

In employment matters mediation is common, both in workplace conflicts and where the company doctor identifies a labour dispute behind sickness absence; see our articles on In family matters it often produces the parenting plan the court requires, as explained in

What should you check before a mediation?

  • Whether the mediator is listed in the MfN register and which technique they use.
  • What your best alternative is if no agreement is reached, including litigation costs and duration.
  • Whether the person attending can actually bind your company.
  • Whether confidentiality, fees and attendance of advisers are agreed in writing.
  • Whether a limitation period must be interrupted under Article 3:317 BW before you start.

  • Mediation in the Netherlands is voluntary and not regulated by a general statute; the MfN register sets professional standards.
  • The five common techniques are interest-based, facilitative, transformative, evaluative and narrative mediation.
  • Confidentiality depends mainly on the written mediation agreement.
  • A settlement under Article 7:900 BW binds, but needs a notarial deed or court record to be directly enforceable.
  • Domestic mediation does not stop a limitation period; interrupt it under Article 3:317 BW.

The mediation process itself is voluntary and the mediator decides nothing. The final settlement agreement (vaststellingsovereenkomst) under Article 7:900 BW is binding, even where it departs from what the law would otherwise have given the parties.

Can a Dutch court force parties into mediation?

No. A judge can propose mediation at any stage of proceedings and refer the parties to the court mediation desk, but participation and any settlement remain voluntary.

Can the mediator be called as a witness?

In domestic cases this is mainly excluded by contract in the mediation agreement. In cross-border EU disputes, the Dutch implementing act lets the mediator refuse to testify if confidentiality was expressly agreed.
